At present, if the .co.nz version of the domain has not been registered, then the .nz version is available to register. For .co.nz domains that have been registered, only the owners of the .co.nz domain can register the .nz version of their domain name.
That is, if the .co.nz version of a domain has already been registered, the status of those domains are Preferential Registration or Reservation (PRR) until March 2015.
